Warranty

Scepter Corporation ("Scepter"), the manufacturer of the PoleShark Equipment, warrants, limited as provided below, that the Equipment, at the time of sale by Scepter, will be free from defects in material and workmanship and fit for the purpose for which it is being sold. This warranty is limited to Equipment used strictly in accordance with the provisions of the Operating Manual.

Disclaimer

The obligation of Scepter under the above warranty is also limited to the replacement of Equipment which Scepter determines to be defective and which is returned within a reasonable time after sale. Under no circumstance will Scepter or any distributor of the Equipment be liable for consequential damages for breach of the warranty including damage or injury to persons or property occurring while using the Equipment or as a result of its use, and by accepting and using the Equipment the purchaser and each user thereof accept this disclaimer of liability by Scepter and distributors of the Equipment and release Scepter and every such distributor from any liability whether in contract or in tort in respect of any such consequential damage or injury.

Neither Scepter nor the distributor of the equipment makes any other warranty to any purchaser or user of the Equipment, either express or implied, with respect to the Equipment.
